Ravencrest Homeowners:

On June 30, 2018, at a duly held board of directors’ board meeting, in accordance with RHOA By-Laws Sec. 3 (below); Special Meetings and RHOA Covenants Conditions & Restrictions; ART. VII, Sec. III: Special Assessments of the Ravencrest Homeowner’s Association, the Board of Directors has unanimously voted to host a “Special Assessment” meeting to discuss and vote for a special assessment to acquire the needed funds for maintenance requirements of the retention pond.

Section 3,Special Assessments ln addition to the regular assessments authorized by this Article, the Association may levy a special assessment or assessments in any assessment year,applicabletothatyearonly,forthepurposeofdefraying, inwholeor inpart, thecostofanyconstructionorreconstruction,unexpectedrepairorreplacement ofadescribed capital improvement for which the Association is responsible or for such other purposes as theBoardofDirectorsmayconsidernecessary,providedthatsuchassessmentshallhavethe assent of the Members representing two-thirds (2/3) of the total number of votes eligible to be cast. A meeting of the Members shall be duly called for this purpose, written notice of which shall be sent to all Members at least ten (10) days, but not more than thirty (30) days, in advance of such meeting, which notice shall set forth the purpose of the meeting.Such assessment shall be prorated among the Members on the same basis as annual assessments.

 

At this “mandatory” meeting, which requires all residents (homeowners) to be in attendance to discuss and vote on this special assessment (ballot/proxies will be provided with Special Meeting Notice). The HOA will require a 67% quorum in person or by proxy at the Special Meeting in order to have a valid meeting and vote.  There will be no other business discussed outside the retention pond maintenance endeavor.

Retention Pond Maintenance:

We experienced two major water breaches with our retention pond in 2010 & 2012. These breaches resulted in our retention pond overflowing into some resident’s homes and into the community streets. More so, these floods have significantly eroded away at the shoreline of the pond. This erosion continues to this day, and in areas around the pond have eroded away the five-foot utility easement, which should be connected to all properties on the waterfront.

Our current operating budget cannot absorb this additional cost for the corrective maintenance repair. We have worked hard to avoid an assessment.  We have looked at things we could do to help cover this cost; requested help through the city of Bartlett, requested grants from state of Tennessee to assist with the cost, but there hasn’t been any agreement to assist from any of the efforts. We have no choice but to resort to a special assessment.

 

We assure you that we on the board regret this as much as any of you. After all, we, like you are homeowners in Ravencrest and we have to pay our share of the special assessment per the Ravencrest Covenants, Conditions & Restrictions require of all owners.

There are a couple of maintenance estimates that have been completed and are currently in the process of being considered by the Bank of Bartlett.

Members who can’t pay their share of the special assessment in one lump sum may pay their share in monthly installments over a designated period of time (12-month period) to be further discussed at the special meeting. The first installment is estimated to start in 2020. The special assessment amount will be a separate payment/check from your normal annual dues and will be designated for our Retention Pond Maintenance Assessment only.

Please note, pursuant to Sec. 6; Non-Payment of Assessments: Ravencrest Homeowner’s Association CC&Rs, if assessments are not paid on the date when due, shall be delinquent and shall, together with interest thereon and the cost of collection thereof, as hereinafter provided, thereupon becoming a continuing lien upon the Lot or Lots belonging to the Member…
